Terms of use for the Access Statement Tool

 

Introduction

 

These terms apply to tourism businesses using VisitEngland’s online Access Statement Tool.

 

By using or accessing any part of this website you agree to be bound by the following terms.   If you do not agree to be bound by these terms please do not access or use the website.  If you would like to use any of our material in a way not covered by these terms, please contact us at qad@visitengland.org 

  

Definitions

 

You or Your      The person entering into this agreement with us by accepting these terms.

 

Us, We or Our   VisitEngland (incorporated by statute as the British Tourist Authority).

 

Service             The Access Statement Tool and any other material relating to a service or services on this website or sent to you by email or by any other means.

 

Authority

 

We authorise you to use the Service for the purpose of completing your Access Statement on condition that you comply with your obligations under this agreement.  The authority starts when you enter into this agreement and ends if this agreement is terminated.

 

Terms of use of the Service

 

You may:

 

  • View, copy, print out and use material from the Service for the purpose of completing your Access Statement.

 

  • Bookmark or link to any part of the Service.

 

We may without notice make such amendments to these terms and the Service as in our sole discretion we deem necessary, including withdrawal of access to the Service.

 

The Service is provided ‘as is’.   Please note that we will not hold your Access Statement indefinitely so you are advised to save a copy to your computer. The Best Practice examples reflect VisitEngland’s belief as to what constitutes best practice and does not necessarily reflect those of others.

 

 

Your obligations

 

You will use our website, the Service and your Access Statement only for improving the information about your business; you may not use it for training other people or for any other commercial use.

 

You will not:

 

  • Alter, sell or distribute any part of the Service; or
  • Assign or otherwise dispose of your or our rights under this agreement; or
  • Contest our intellectual property rights in our website, the Service or the Access Statement Tool; or
  • Promote your Access Statement as being endorsed or verified by VisitEngland.

 

You are responsible for configuring your information technology, computer programs and platform in order to access the Service.  You should use your own virus protection software.

 

You are responsible for completing your Access Statement. 

 

Our obligations

 

We warrant that your use of the Service will not infringe any third party rights.

 

We will take reasonable steps to ensure that software and data files we supply to you as part of the Service are virus free.

 

We will take reasonable steps to ensure that the Service is continuous and, except for maintenance, uninterrupted.

 

Disclaimer

 

Whilst we take all reasonable steps to ensure that the Service is accurate and up-to-date we can accept no liability for any out-of-date material, errors, omissions or loss of functionality resulting in lost or corrupted data.  We give you no warranty or assurance, except as set out above, regarding the Service.  We give you no warranty or representation that your use of the Access Statement Tool will fulfil your obligations under the Disability Discrimination Act 1995 or any ancillary legislation.  In no event shall VisitEngland be liable for any loss or damages, including, without limitation, indirect or consequential loss or damage, whatsoever arising from your use of our website, the Service and your Access Statement.  This does not affect claims in respect of death or personal injury caused by our negligence and does not limit or exclude any liability for our fraudulent misrepresentation.

 

Termination

 

This agreement will terminate if you are in material beach of any of its terms or if any non-material  breach is not remedied within a period of ten days after we have given you notice of it.

 

On termination of this agreement you will take reasonable steps to delete the Service and any part of it from your electronic media, including your intranet and electronic storage devices.  You are not required to delete that part of your Access Statement which you have completed on-line.

 

Data protection and privacy statement

 

Any personal information that you provide to VisitEngland will be handled by us in accordance with the Data Protection Act 1998 (‘DPA’) and the Privacy and Electronic Communications Regulations (EC Directive) Regulations 2003 as amended from time to time.  For the purposes of the DPA the Data Controller is VisitEngland.

 

Information which you provide which is part of your Access Statement will be stored by us and data therefrom which does not identify you personally may be shared with destination management operators to assist them and us with accessibility initiatives.  Your information will not be used for any other purpose.

 

Copyright and intellectual property

 

The copyright and all other intellectual property in the materials on our website are owned by VisitEngland unless stated otherwise.  You are permitted to print and download extracts from our website subject to the following conditions:

 

  • Use of our documents and related graphics is for your personal use only;
  • Any copies of our materials saved on to disk or to any other storage medium may only be used for subsequent viewing purposes for your personal use;
  • Our documents and related graphics are not to be modified or used separately in any way;

 

Third Party Rights

 

This agreement is not intended to benefit anyone other than you and us and in particular no terms of this agreement shall be enforceable under the Contracts (Rights of Third Parties) Act 1999 by a third party.

 

Applicable Law

 

This agreement is governed by English law and you submit to the jurisdiction of the English courts.
